Privacy Policy / Terms of Use

The Memphis Brooks Museum of Art (Brooks), is committed to protecting your privacy when you visit our Website. Use the Website to purchase admission or event tickets or a Brooks membership, or make an online donation. The BROOKS does not collect personally identifiable information about individuals (“Personal Information”), such as names and mailing or e-mail addresses, unless the individual visiting the Brooks Website (collectively referred to as the "Brooks Website") knowingly provides it. By using the Brooks Website, you agree to be bound by the terms and conditions of Brooks’ Privacy Policy. By providing Personal Information, you consent to our collection and use of it, as described in this Privacy Policy. The Brooks Privacy Policy governs our use and disclosure of Personal Information collected only through the Brooks Website. The Brooks Privacy Policy is outlined below.


1. The Brooks’ Policy on Collecting Information on the Brooks’ Website

Non-Personal Information

When you log into the Brooks Website, the Brooks automatically collects information about your Internet connection, including but not limited to: (i) the name of the Internet domain you used to access the Internet; (ii) the IP address of the website from which you linked directly to the Brooks Website; (iii) the date and time you accessed the Brooks Website; and, (iv) the pages you visited. This information (“Non-Personal Information”) does not identify you personally. We use this Non-Personal Information to monitor the effectiveness of the Brooks Website and to consider potential improvements to the Brooks Website.

Online Purchases

When you purchase an admission or event ticket, we need to know your name, billing and address, telephone number, e-mail address, and credit card information to process your order. Your credit card information will be used only as needed to process your transaction. When you make an event ticket purchase online, your credit card information will be temporarily stored on a secure server. We will retain the personally identifiable information you provided for our records and to facilitate customer service.

Online Memberships and Donations

When you purchase a Brooks membership or make a donation to the Brooks online, we will ask you to provide us with the information we need to process your membership and/or to acknowledge your contribution. This information includes your name, billing and shipping addresses, telephone number, e-mail address, and credit card information. Your credit card information will be used only as needed to process your transaction. When you make a donation or purchase a Membership online, your credit card information will be temporarily stored on a secure server. We will retain the personally identifiable information you provided for our records and to facilitate customer service.

Online Surveys

From time to time, the Brooks may invite you to participate in surveys posted on the Brooks Website or sent to you by e-mail. You may decide whether or not you wish to complete such surveys, which may ask about your background, occupation, or similar questions. We use this information to help us better understand our visitors needs and interests, which in turn allows us to better meet your expectations.

Online Contests

The Brooks will occasionally offer visitors the opportunity to participate in online contests or sweepstakes. If you choose to enter, you will need to provide your name and e-mail address so that we may contact you in connection with the contest. We may also request that you provide us with certain additional information, but not limited to your address, phone number and grade in school.

eBrooks

As a service, the Brooks offers visitors to the Brooks website the opportunity to subscribe to one or more of our online newsletters. If you choose to subscribe, you will receive eBrooks news on the topics you choose. You may subscribe or unsubscribe at any time by following the simple instructions at the bottom of each newsletter. On occasion, the Brooks may send e-mails to individuals who have provided us with their e-mail address, informing them of museum events or promotions we think may be of interest.

2. How the Brooks Uses Information Provided by Visitors

Use of Personal Information

The Brooks uses the personal information you provide to us for internal purposes, such as filling and tracking your purchase, analyzing trends and collecting statistics. The Brooks may also compile and provide aggregate statistics about our visitors, customers, sales, traffic patterns and related site information to third parties, but these statistics will not include any personally identifying information.

We may contact you to inform you of an event or promotion that we believe would interest you. You may opt out of receiving such communications from the Brooks by contacting us at
brooks@brooksmuseum.org. The Brooks may disclose personal information when such disclosure is reasonably necessary to comply with the law; enforce the terms of any of our user agreements; or protect the rights, property, and safety of Brooks, the users of its site, or others. We may combine information you give to us online, in our store, or at the museum.

We may also combine this information with publicly available information and information we received from or cross-reference with our third-party vendors and others. We use this combined information to enhance and personalize your shopping experience with us, to communicate with you about products or events that may be of interest to you, or for other promotional purposes.

Use of Outside Vendors

The Brooks may from time to time retain qualified third-party vendors in order to help us manage the Brooks website and allow us to better serve our visitors and customers. These may include third-party vendors we engage to analyze the information we collect on the Brooks website for marketing or similar purposes. The Brooks requires its vendors to maintain the security of the information to which they are provided access and restricts the vendors from using the information in any way not expressly authorized by Brooks. We may contract with third parties who use cookies to collect information on our behalf. These parties are required to maintain the confidentiality of this information. If you would like to opt out of this use of your information, you can change the preferences of your browser so that it does not accept cookies. We may contract with companies or others to provide certain services, including credit card processing, data management, promotional services, etc. We provide these service providers with the information they need to perform these services, but we restrict the vendors from using the information in any way not expressly authorized by Brooks.


Transfer of Ownership of Collected Information

Brooks is the sole owner of the information collected on or through the Brooks website. Information collected from you may be transferred to a third party as a result of a sale, acquisition, merger or bankruptcy involving Brooks.

3. Use of Cookies

Cookies are small files of information that are stored on your computer's hard drive by your web browser. The cookies we use do not contain any personal information. We place cookies on visitors’ computers to collect aggregate information for site traffic analysis, such as the number of visitors and the number of pages viewed. Most web browsers automatically accept cookies, but you can change the preferences of your browser so that it does not accept them.

4. Linked Sites

The Brooks website may include links to websites operated by third parties over which we have no control. Brooks is not responsible for the privacy practices of such other sites and encourages you to be aware when you leave the Brooks website and to read the privacy policies of each and every website that collects personal information. Once you leave the Brooks website, the Brooks Privacy Policy will not apply, and you access such sites at your own risk.

5. Brooks Does Not Solicit Personal Information from Children

Visitors twelve years of age and under should remember that they are required to obtain an adult's permission before submitting any personal information to this or any other website. If your child has submitted personal information and you would like to request that such information be removed, you may contact us via one of the contact methods described on the Brooks website and we will promptly remove such information and shall not use such information or include it in our database. Users ages twelve and under and their parents or guardians are advised that any personal information voluntarily entered by children may be available for use until Brooks becomes aware that a user is under the age of thirteen and has had a reasonable opportunity to remove the information from the Brooks website.

6. Security Measures

SSL encodes your personal information, including credit card number, name, and address, as it travels over the Internet so that all transactions are secure. If you prefer, you may also purchase event tickets over the phone by calling 901.544.6200. For membership or donations, please call 901.544.6230. Disclaimer: The Brooks Museum takes commercially reasonable precautions to protect your personal information both online and off-line, but absolute security cannot be guaranteed. It is important for you to protect against unauthorized access to your password and to your computer. The Brooks shall not be liable for the transfer of any personal information resulting from loss or distribution of data, the corruption of storage media, power failures, natural phenomena, riots, acts of vandalism, sabotage, terrorism or any other event beyond the Brooks’ reasonable control.

7. Revisions to the Brooks’ Privacy Policy Revisions to our Privacy Policy

Please note that Brooks may revise its privacy policy at any time, without notice, such changes to be effective immediately upon posting on the Brooks website. Such revisions may arise in response to changes in the law, policy, or other factors. You agree to be bound by this Privacy Policy and any modifications to this Privacy Policy occurring prior to your continued use of the Brooks website. We encourage you to periodically visit this page to review our most current policy.
